ערנות לזכויות האדם הגישה דו"ח לבדיקה התקופתית של ישראל במועצת זכויות האדם של האו"ם

 עמותת ערנות לזכויות האדם הגישה דו"ח לבדיקה התקופתית של זכויות האדם בישראל ע"י מועצת זכויות האדם של האו"ם.  הדו"ח מספק נתונים המצביעים על התדרדרות נוספת ביושרת מערכת המשפט ושלטון החוק בישראל. המצב בישראל מתואר כמשבר חוקתי והתפוררות חברתית, שמדינת ישראל תתקשה לתקן בעצמה, שכן המגמות התרבותיות, החברתיות והפוליטיות בישראל נוטות להקצין את המצב. הדו"ח מחווה דעה, שתיקון ייתכן רק בתגובה ללחץ חיצוני כבד, שאינו צפוי בעתיד הנראה לעין.

הדו"ח הקודם של העמותה (2018) עבר את בדיקת המומחים ונכלל בדו"ח הסופי של המועצה על ישראל וסוכם כ"התדרדרות חמורה ביושרת רשויות החוק והמשפט בישראל...".

הבדיקה עצמה תיערך בסביבות אפריל-מאי 2023. כל חברה באו"ם עוברת בדיקה מסוג זה כל כ-5 שנים. בסבב עם ישראל תיערך בדיקה גם של פולין, יפן, צ'אד, קפריסין ועוד.

בשני הסבבים האחרונים (2013, 2018) ממשלת ישראל הכריזה שהיא מחרימה את מועצת זכויות האדם של האו"ם, והשתתפה בהליך הבדיקה רק לאחר לחץ בינלאומי. 

הבדיקה של ישראל בסבב הקרוב צפויה להיות מעניינת במיוחד, שכן היא תעמוד בצילה של סדרת דוחות מהשנתיים האחרונות, שחיוו דעה שישראל היא משטר אפרטהייד - פשע נגד האנושות, ולאחר שקבוצת המשקיפים של האו"ם הוציאה הודעת גינוי חריפה של בית המשפט העליון בעקבות פסק הדין בבג"ץ 413/13 אבו עראם נ' שר הביטחון, שאישר את פינוי הפלסטינים במסאפר יטא לצורך ניהול שטח אש.

Incompetence and lack of integrity of law and justice in Israel

Executive Summary

The Human Rights Alert [HRA-NGO] submission documents further deterioration in integrity the courts, the legal profession and the rule of law in Israel.

Further evidence is provided of invalidity of Net-HaMishpat - case management systems of the courts. Particularly, invalidity of the fundamental Books of Court - Index of All Cases and Judgment Book. Such evidence indicates incompetence and lack of integrity of the courts. The Roman Zadorov affair documents the production of patently invalid, or vague and ambiguous judgment records in a murder trial. The Amos Silver affair documents the invalidity of Index of All Cases.

The Sex for Judicial Appointment scandal crystallizes the failure to hold judges, attorneys and law enforcement personnel accountable.

In recent years, the Israeli regime has gained wide recognition as an apartheid regime. Judgments of the Israeli Supreme Court rule in matters of “Equality” in a manner that a notable Israeli law professor describes as “surrealistic”.

The occupation of Palestine is no doubt the defining feature of the Israeli regime today. A series of Israeli and international NGO reports find the State of Israel an apartheid regime. The Israeli justice system is perceived as providing a fig leaf for apparent war crimes and crimes against humanity. Supreme Court Justice M. Mazuz resigned on this background. Yehudism - a nationalist, racist, violent and murderous ideology, characteristic most notably of the Jewish settlers movement, provides a perverted religious/moral foundation for the occupation and its abuses, undermining the rule of law. It appears to be prevalent if not the reigning ideology among the echelons and rank and file of the security apparatus.

With a 5^th cycle of general election in less than 3 years and increasing loss of public trust in state agencies and institutions, including the election process itself, the circumstances should be deemed social disintegration and a constitutional crisis (in a nation with a disputed constitution).

Prevailing conditions in Israel will be difficult or impossible to address from within. Internal cultural, societal and political long-term trends seem to only radicalize the situation. Corrective actions may only appear in response to intense international pressure, which in the foreseeable future is unlikely either.
