On Saturday, Icelandic member of parliament Birgitta Jónsdóttir posted a nomination letter on her blog on behalf of the three-member parliamentary group The Movement, proposing suspected WikiLeaks source Bradley Manning as a candidate for the 2012 Nobel Peace Prize. Nobel Peace Prize nominations can be submitted by any member of a national assembly, among others.

     Over the past decade, US corporations IBM and EDS have been involved in development of the electronic record systems of the courts of the State of Israel.

According to the State Ombudsman 2010 report (60b): [1]-         The corporations were awarded contracts with no bidding;
-         Development was initiated with no written specifications;
-         No state employees were involved in core supervision, only individuals on personal special consulting contracts;
-         The state customer did not perform any independent examination of the systems prior to implementation;
-         The servers are located on corporate grounds, not under the courts administration;
-         Unknown number of persons issued double smart ID cards.

Previous reports documented that the systems, developed by these corporations undermined the integrity of court records in Israel.  [2]
Below are search results regarding involvement of IBM, EDS in other cases of corruption of governments.

As is often the case with high level corruption, one can assume that most cases are never exposed.

Although the systems implemented in the Israeli courts and the US courts are very different, the nature of the fraud in their systems is similar, and the end results are identical: conduct of simulated litigation and publication of simulated court decisions and judgments, and refusal of the offices of the Clerks of the courts to certify the courts' decision. "A court, which refuses to certify its own decisions, is certified corrupt," concludes Joseph Zernik, PhD, of Human Rights Alert (NGO).

IBM's recent anti-corruption campaign in China has reportedly resulted in the resignation or downgrading of more than 120 employees in the company's Chinese offices.
The Chinese media reported that about a month ago, over 120 employees from IBM China were investigated. Of them, about 100, including two top executives, were downgraded to a lower position and more than 20 others were asked to leave the company. According to China's CBN Weekly, most of the employees involved are from the company's sales and service departments.

An American Spring is in the Air

I had the privilege of moderating (a glorified term for an on-air switchboard operator) anInterOccupy call a couple of nights ago. Kevin Zeese and Margaret Flowers, two of the movement's best known organizers, both very active in Occupy Washington DC, answered questions about "Occupy Phase 2," the directions that the movement should take in the Spring. The main point was that "Phase 2" should involve setting up alternate economic structures designed to weaken the "pillars of power." An illustration of this is setting up local alternatives to the banking system. During "Phase 2," non-violent protest, the hallmark of "Phase 1," was said to be important to continue. It was noted that non-violence is even more important now, amid signs that those in power may be worried that some of the pillars that keep them in power, such as local police forces, may be sympathetic to the Occupy movement. NowDC, the National Occupation of Washington D.C., slated for April, will an important step in coordinating separate occupations nationally, and for its actions to be taken to pressure Congress, when it returns from Spring recess. In addition to "Phase 2," miscellaneous questions were addressed, including whether the movement should focus on the 2012 elections, and what to do in the period afterwards.

InterOccupy hosts several national conference calls each week to promote communication between individuals, Working Groups and local General Assemblies, across the Occupy movement. The conference calls focus on organization and special topics. The contacts allow for cross-fertilization between local groups. Tips such as "what works for us," can be discussed, or advice on how to cope with setbacks can be shared. This particular call was in a category called "Hot Topics," which brings in a weekly speaker (or speakers, in this case) to address issues of interest.

Alternative Economic Structures

As an introduction to the talk, Margaret Flowers referenced the "Pillars of Support" defined by Robert Helvey in his book "On Strategic Non-Violent Conflict." The idea is that "when important pillars of support are sufficiently undermined, the government, or the opposition, collapses just as a building will collapse upon itself when its support structure is weakened and gives way." In our society, those pillars are the police, the military, civil servants, media, the business community, youth, workers, religious organizations, and NGOs. Not every pillar has to stand at the same time, of course.

Continuing the Pressure
Non-violent protest, the hallmark of "Phase 1" should continue, as per Zeese and Flowers. Particular attention was paid to the importance of non-violence. The police are one of the "pillars." By being non-violent, the public perceives the movement as exercising its right to free speech. When the police or other forces use violence upon a non-violent protest, the movement gathers the public's sympathy and respect. Any violence on the part of the movement, even if provoked, hurts the movement.

The National Occupation of Washington D.C.
NowDC is in some ways an effort to kindle an American Spring. More than just an occupation in the style of OWS, it will feature planning events centered on the alternate economic structures described above, a social component to lay the groundwork for ongoing national communications and coordination, and possibly an event or action upon the return of Congress from Spring recess.

Though not strictly part of the discussion, in response to caller questions, Zeese provided a perspective on the 2012 Presidential auction. Simply put, the conversation between President Obama and the Republican nominee is a false conversation, for what will be said is only what those nominees' contributors allow them to say.

ABC News Producer Dan Lieberman called me in mid-January 2012 to tell me he come to Florida the following week and wanted to interview. He had read articles I had written and posted to my blog and Lawmen group. I hadn’t known him as any particular news producer. I said “Sure.”

Dan came into my home and interviewed me on his small camera. He seemed interested in sovereign citizen. I told him I thought myself the wrong person, and he said he thought I was exactly the right person. I explained that I didn’t consider myself a member of any “sovereign citizen” group. Dan asked me to round up others willing to be interviewed.

Dan proceeded to ask me whether I believed any circumstances justify violence against government. I explained that violence means unlawful physical force, and that both the Constitution of Florida and the Declaration of Independence fully justify the use of physical force to “alter or abolish their form of government”.

Update 4:25 pm: At least two protesters from Freedom Park who went to the McPherson Park to offer assistance have been injured. It has been reported that an occupier named Mike has a hairline fracture in his arm, resulting from being hit by police. Another occupier, Taylor, has reportedly been tased and arrested.

A GA (General Assembly) is scheduled for 5 pm at Freedom Plaza. Sgt. Beck from the DC Park Police will reportedly be giving further instructions for compliance, although it has been noted that the police did not seem to honor the fact that many tents or areas in McPherson Park were in compliance, and were removed or destroyed anyway. Word queries were performed on ELYON1 for various word combinations, reflecting variations in the certification boxes of decisions of the Supreme Court in the years 1991-2011. The results provide insights into events of 2001-2, a critical period relative to the compromised integrity of the electronic records of the Supreme Court. The analysis also allows the detection of decisions listed under false certifications (e.g., certifications by Clerk Shamryahu Cohen, long after the date of his death) and false dates (at times back-dated up to a decade). Combined, the analysis provides additional evidence of the compromised integrity of the electronic records of the Supreme Court.
Computing experts are readily available in Israel, who could examine and provide solutions. However, resolution of false records, already entered in the system, is likely to require the establishment of a Truth and Reconciliation Commission.

Jerusalem, February 7 – “Events of early 2001-2 should be considered critical in compromising the integrity of the electronic records of the Supreme Court,” says Joseph Zernik, PhD, of Human Rights Alert (NGO), “These events involved Electronic Data Systems Corporation [NYSE:EDS] and IBM Global Technology Services [NYSE: IBM], two well-known US corporations.”

Today, Dr Zernik has released further analysis of the distribution of particular word combinations, derived from various certification boxes of the electronic records of the Supreme Court over the past decade. (Tables IIIa – linked above)

The analysis shows that events of early 2002 were preceded by specific increase in the appearance of the following word(s):

Starting 1997 – “Rasham“ [Magistrate- jz];
Starting 2000 – “Aricha Ve-Nisu’ah” [editing and phrasing – jz];
Starting 2000 – “Terem Pirsumo Be-Kovetz” [prior to publication in compilation…-jz];
Starting 2001 – “Merkaz Meida” [Information Center – jz], and
2001-2002 – “COURT.DOT” [Word template file name – jz] – appeared almost exclusively during the same two years.

Events of early 2002 were followed by changes in the appearance of the following word(s):

Early 2002 – “Shmaryahu Cohen” disappeared;
Late 2002 – “Sarah Lifschitz” briefly appeared, and
Early 2003 – “Mat’im La-Makor” [True copy of the original… -jz] disappeared.

Detailed review of orders and judgments, which appear outside their typical distribution pattern, shows common discrepancies in the dates of the records. (Table IIIb – linked above)
Previous analysis of the records of the Supreme Court documented:

The publication of simulated records and the conduct of simulated litigation; [1]
Variations in the certification boxes of the records over the past decade that ended with no certification at all; [2]
Discontinuities in the certification authority of the records; [3]
Refusal of the office of the Clerk of the Court to certify Supreme Court records, even upon request, [4] and
Missing ID certifications of the Supreme Court servers. [5]

Several Israeli computing and legal experts expressed concern regarding these findings.

The State Ombudsman 2010 report (60b) additionally noted, regarding development and implementation of the systems, that: [6]

Corporation were awarded state contracts with no bidding, as required by Israeli law and regulations;
Development was initiated with no written specifications;
Development was supervised by individuals on special personal contracts, with no core supervision by state employees, as required by Israeli law and regulations;
No independent inspections were conducted by the state customer prior to implementation of the systems;
The servers were located under corporate control, not under the State Courts Administration, and
Unknown number of individuals had issued double smart ID cards.

“It is not clear, who controls the electronic records of the Supreme Court today,” says Dr Zernik, “What is clear is that the office of the Clerk of the Court refuses to be held accountable for the integrity of the Supreme Court’s records.”

As a follow-up, Dr Zernik has filed Freedom of Information requests with the Courts’ Administration, asking for records that:

Explain the process and substance of the changes in the certification boxes of the Supreme Court from 2001 to 2003, [7] and
Document, which individuals or entities held the ultimate administrative authority for the serves of the Supreme Court over the past decade, and how that authority was established and transferred. [8]

“Data protection and cryptology experts are readily available in Israel, who could examine the systems and propose solutions,” says Dr Zernik, “However, any solution is likely to also require a Truth and Reconciliation Commission, to address the false records already entered in the systems.”
Dr Zernik had previously shown that the electronic record systems of the California and US courts enable and are routinely employed for fraud on the People by large corporations and financial institutions in collusion with the courts. [9,10]

The 2010 submission of Human Rights Alert to the Human Rights Council (HRC) of the United Nations was reviewed by the HRC professional staff and incorporated in the official HRC Professional Staff Report with a note referring to “corruption of the courts and the legal profession and discrimination by law enforcement in California.” [11]

If current events continue in their present direction, seven of the world's largest and most influential tech companies may have to pay anywhere from 5% to 10% of the yearly earnings of tens of thousands of their employees. Not only that, but these payouts may have to be calculated all the way back to 2005.

As reported by TechCrunch, Google, Apple, Adobe, Intel, Intuit, Pixar, and Lucasfilm are now defendants in a class action lawsuit alleging that the tech giants conspired together with the purpose of violating long-standing antitrust laws in order to artificially suppress the wages of their employees.
...As the lawsuit states, "The DOJ has confirmed that it will not seek to compensate employees who were injured by defendants'[tech companies] agreements. Without this class action, plaintiff [employees] and members of the class will not receive compensation for their injuries, and defendants will continue to retain the benefits of their unlawful collusion."

Jerusalem, January 31 - Joseph Zernik, PhD, of Human Rights Alert (NGO), has forwarded to the Courts Administration a request for records, pertaining to the identity of those holding the ultimate administrative authority for the servers of the Supreme Court of the State of Israel. [1]

A series of reports, recently published online by Dr Zernik, has first shown a pattern of online publication of simulated records on the servers (ELYON1 and ELYON2), [2,3] and the failure and refusal of the Office of the Clerk of the Supreme Court to certify the Court's own records. [4-6] Furthermore, ambiguity was shown in the identity certifications of the Supreme Court servers. [7]
The 2010 report of the Israeli Ombudsman Judge (Ret) Lindenstrauss, [8] raised serious concern regarding the integrity of the development and implementation of the computer systems of the Israeli courts as well. Several corporations were involved in development with no bidding and with no core supervision by state employees. The corporations were only identified in the Ombudsman's report as A, B, and C. Media identified the corporations: EDS, Teldor, and IBM Global Services. [9-11]
"Today's request attempts to establish, who indeed maintains and safeguards the integrity of the records of the Supreme Court of the State of Israel," concludes Dr Zernik, "The evidence so far would lead any reasonable person to conclude that it is NOT the Clerk of the Supreme Court of the State of Israel."

Dr Zernik had previously shown the refusal of the Clerk of the Los Angeles Superior Court and the Clerks of the US courts from coast to coast to certify their own decisions, orders, and judgments, which were published in the same courts' online public access systems. "Any court, where the Clerk refuses to certify the Court's own records, is certified corrupt," says Dr Zernik, "it is part of a global culture of Corporate-Government Criminality." [12-13]
According to Dr Zernik, a critical difference between conditions in the US and in Israel is that in Israel, both computing and legal scholars are willing to discuss the problems and propose solutions. Legal and computing experts in the United States have consistently refused to opine on these matters. [14-16]
Integrity of the electronic record systems of the courts is critical in the safeguard of Human Rights and Socio-economic Development in the digital era.

A capital asset, which can and should be enumerated. The immunity for past and future criminality is beneficial to the executives, and detrimental to the shareholders. As such, the immunity should be recognized as a driving force in recent mergers and acquisitions. Los Angeles and Jerusalem, January 30 - in view of President Obama's staunch campaign for a US-wide "settlement" of criminality against the People by banking institutions, Joseph Zernik, PhD, of Human Rights Alert (NGO), proposed to the economic/legal community a new theory: Perpetual corporate immunity as a major capital asset.

The final bill will effectively cover both past and future criminality.

The proposed "settlement" cannot be reasonably deemed applicable only to past conduct. The conduct is ongoing, and part of a pattern of Corporate-Government Partnership in Criminality, patronized by the courts. Therefore, the immunity for past criminality was already in effect prior to President Obama's initiative. As currently presented, the new initiative may need to be periodically renewed. However, this deficiency is likely to be resolved behind closed doors in conference of the House and Senate, in order to streamline the work of future Congresses and to increase long-term markets stability.

The immunity will be transferrable and perpetual.

Legal-economic theorist should recognize that such immunities are already effectively perpetual, pursuant to the US law, and therefore transferrable upon mergers, acquisitions, and changes of control. The best case study in this respect is the immunity for both past and future criminality, which had been vested in Countrywide Financial Corporation at least since the early 2000's. Upon close examination of the events since January 2008, one must conclude that it was fully transferable, and since the July 1, 2008 takeover is vested in Bank of America.

The immunity is a major capital asset, which can, and should be enumerated.

In examining corporate takeovers and acquisitions, the decision making process and accounting, the immunity should be consider a major asset. In the taking over Countrywide Financial Corporation, Bank of America paid ~$4.5 billions in stock. In return, Bank of America received a corporation with billions of dollars in negative assets, billions of dollars in civil legal liabilities, and clear and present criminal liabilities to top it off. The only way to rationalize the transaction within the framework of current legal-economic theory, is to assume that the large discrepancy was offset by the transfer of the Countrywide's immunity to Bank of America, even if this part of the transaction was left confidential.

Perpetual corporate immunity for criminality is a unique corporate asset, with differential benefits for executives and shareholders.

As seen in the Bank of America- Countrywide case, this major asset, had differential effects and yields:
Shareholders of Bank of America lost about 90% of the value of their holdings. The executives were vastly enriched.

The differential effect of this the immunity is a major driving force in contemporary socio-economic development, or lack thereof.

This differential effect can be explained by the fact that the market implicitly comprehended the nature of the transactions. Following the merger, some analysts described Bank of America quarterly reports as "delusional". Obviously, there was no concern in Bank of America with filing fraudulent reports. Current share price reflects market sentiments regarding this management style -Corporate-Government Partnership in Criminality. On the other hand, the same legal-economic factors led to continued escalation in executives' compensation. The differential effect should be recognized as a major driving force in contemporary socio-economic development, or lack thereof.

European nations should entertain this analytic framework

In contemplating their own "settlements", European nations should also consider the expected outcome - economic stagnation and impoverishment of the People.  The immunity provided to the medieval German Robber Barons and the immunity acquired by American corporations during the American Robber Baron Era, are clear historic precedents of the same processes.

Police in Oakland, California, have used tear-gas and flash-grenades as a 2,000-strong Occupy Oakland march turned violent, with some protesters claiming that rubber bullets had been also fired into the crowd. At least 300 people were arrested, police say.

The demonstrators attempted to take over a vacant building to use as their headquarters. As they began tearing down perimeter fences around the HenryJ. KaiserConvention Center, police declared an unlawful assembly and used force, according to the Oakland Tribune newspaper.

Italy anti-austerity protests reach Sicily

From North to South, the number of Italians dissatisfied with the reforms and tax hikes introduced by the government led by Prime Minister Monti, keeps growing.

In Sicily, a series of strikes organized by protest movements has brought the island to its knees.

The Shock Wave Group - composed of angry truck drivers - and the Sicilian haulage companies association blocked roads, motorways and the gates of the major ports in the past days.

Their roadblocks and blockades have led to a lack of petrol at gas stations all over the island. On certain highways the price of fuel jumped to 3 Euros a liter and groceries became a scarce resource in shops and supermarkets.

Truck drivers believe that the price of fuel has reached unsustainable levels as the cost to transport goods is greater than the cost of the actual products.

OBAMA ELIGIBILITY COURT CASE -BLOW BY BLOW

Given the testimony from today's court case in Georgia, Obama has a lot of explaining to do. His attorney, Jablonski, was a NO SHOW as of course, was Obama.

The following is a nutshell account of the proceedings.

Promptly at 9am EST, all attorneys involved in the Obama Georgia eligibility case were called to the Judge's chambers. This was indeed a very interesting beginning to this long awaited and important case.

The case revolved around the Natural Born clause of the Constitution and whether or not Obama qualifies under it to serve. More to the point, if found ineligible, Obama's name would not appear on the 2012 ballot in Georgia.

With the small courtroom crowded, several in attendance could be seen fanning themselves with pamphlets as they waited for the return of the attorneys and the appearance of the judge.
Obama himself, who had been subpoenaed to appear, of course was nowhere near Georgia. Instead, Obama was on a campaign swing appearing in Las Vegas and in Colorado ignoring the court in Georgia.
Over the last several weeks, Obama’s attorney, Michael Jablonski, had attempted several tactics to keep this case from moving forward. He first tried to have it dismissed, then argued that it was irrelevant to Obama. After that, Jablonski argued that a state could not, under the law, determine who would or would not be on a ballot and later, that Obama was simply too busy with the duties of office to appear.
After all these arguments were dispatched by the Georgia Court, Jablonski, in desperation, wrote to the Georgia Secretary of State attempting to place Obama above the law and declared that the case was not to he heard and neither he nor his client would participate.

Secretary of State, Brian Kemp, fired back a letter hours later telling Jablonski he was free to abandon the case and not participate but that he would do so at his and his clients peril.

Game on.
5 minutes.
10 minutes.
15 minutes with the attorneys in the judge's chambers.
20 minutes.

It appears Jablonski is not in attendance as the attorneys return, all go to the plaintiff table 24 minutes after meeting in the judge's chambers.
Has Obama's attorney made good on his stated threat not to participate? Is he directly ignoring the court's subpoena? Is he placing Obama above the law? It seems so. Were you or I subpoenaed to appear in court, would we or our attorney be allowed such action or, non action?
Certainly not.

Court is called to order.
Obama's birth certificate is entered into evidence.
Obama's father's place of birth, Kenya East Africa is entered into evidence.
Pages 214 and 215 from Obama's book, 'Dreams from My Father' entered into evidence. Highlighted. This is where Obama indicates that, in 1966 or 1967 that his father's history is mentioned. It states that his father’s passport had been revoked and he was unable to leave Kenya.
Immigration Services documents entered into evidence regarding Obama Sr.
June 27th, 1962, is the date on those documents. Obama’s father’s status shown as a non citizen of the United States. Documents were gotten through the Freedom of Information Act.
Testimony regarding the definition of Natural Born Citizen is given citing Minor vs Happersett opinion from a Supreme Court written opinion from 1875. The attorney points out the difference between “citizen” and “Natural Born Citizen” using charts and copies of the Minor vs Happersett opinion.
It is also pointed out that the 14th Amendment does not alter the definition or supersede the meaning of Natural Born. It is pointed out that lower court rulings do not conflict with the Supreme Court opinion nor do they over rule the Supreme Court Minor vs Happersett opinion.
The point is, to be a natural born citizen, one must have 2 parents who, at the time of the birth in question, be citizens of the United States. As Obama’s father was not a citizen, the argument is that Obama, constitutionally, is ineligible to serve as President.

Judge notes that as Obama nor his attorney is present, action will be taken accordingly.

Carl Swinson takes the stand.
Testimony is presented that the SOS has agreed to hear this case, laws applicable, and that the DNC of Georgia will be on the ballot and the challenge to it by Swinson.

2nd witness, a Mr. Powell, takes the stand
Presents testimony regarding documents of challenge to Obama’s appearance on the Georgia ballot and his candidacy.
Court records of Obama’s mother and father entered into evidence.
Official certificate of nomination of Obama entered into evidence.
RNC certificate of nomination entered into evidence.
DNC language does NOT include language stating Obama is Qualified while the RNC document DOES. This shows a direct difference trying to establish that the DNC MAY possibly have known that Obama was not qualified.
Jablonski letter to Kemp yesterday entered into evidence showing their desire that these proceedings not take place and that they would not participate.
Dreams From My Father entered.

Mr. Allen from Tuscon AZ sworn in.
Disc received from Immigration and Naturalization Service entered into evidence. This disc contains information regarding the status of Obama’s father received through the Freedom of Information Act.
This information states clearly that Obama's father was NEVER a U.S. Citizen.

At this point, the judge takes a recess.

The judge returns.

David Farrar takes the stand.
Evidence showing Obama's book of records listing his nationality as Indoneasan. Deemed not relevant by the judge.

Orly Taitz calls 2nd witness. Mr. Strump.
Enters into evidence a portion of letter received from attorney showing a renewal form from Obama's mother for her passport listing Obama's last name something other than Obama.

State Licensed PI takes the stand.She was hired to look into Obama's background and found a Social Security number for him from 1977. Professional opinion given that this number was fraudulent. The number used or attached to Obama in 1977, shows that Obama was born in the 1890. This shows that the number was originally assigned to someone else who was indeed born in 1890 and should never have been used by Obama.
Same SS number came up with addresses in IL, D.C. and MA.

Next witness takes the stand.
This witness is an expert in information technology and photo shop. He testifies that the birth certificate Obama provided to the public is layered, multiple layered. This, he testifies, indicates that different parts of the certificate have been lifted from more than one original document.

Linda Jordan takes the stand.
Document entered regarding SS number assigned to Obama. SS number is not verified under E Verify. It comes back as suspected fraudulent. This is the system by which the Government verifies ones citizenship.

Next witness - Mr. Gogt.
Expert in document imaging and scanners for 18 years.
Mr. Gogt testifies that the birth certificate, posted online by Obama, is suspicious. States white lines around all the type face is caused by “unsharp mask” in Photoshop. Testifies that any document showing this, is considered to be a fraud.
States this is a product of layering.
Mr. Gogt testifies that a straight scan of an original document would not show such layering.
Also testifies that the date stamps shown on Obama documents should not be in exact same place on various documents as they are hand stamped. Obama’s documents are all even, straight and exactly the same indicating they were NOT hand stamped by layered into the document by computer.

Next witness, Mr. Sampson
A former police officer and former immigration officer specializing in immigration fraud.
Ran Obama's SS number through database and found that the number was issued to Obama in 1977 in the state of Connecticut . Obama never resided in that state. At the time of issue, Obama was living in Hawaii.
Serial number on birth certificate is out of sequence with others issued at that hospital. Also certification is different than others and different than twins born 24 hours ahead of Obama.
Mr. Sampson also states that portion of documents regarding Mr. Sotoroe, who adopted Obama have been redacted which is highly unusual with regards to immigration records.
Suggests all records from Social Security, Immigration, Hawaii birth records be made available to see if there are criminal charges to be filed or not. Without them, nothing can be ruled out.
Mr. Sampson indicates if Obama is shown not to be a citizen, he should be arrested and deported and until all records are released nobody can know for sure if he is or is not a U.S. Citizen.

Taitz shows records for Barry Sotoro aka Barack Obama, showing he resides in Hawaii and in Indonesia at the same time.

Taitz takes the stand herself.
Testifies that records indicate Obama records have been altered and he is hiding his identity and citizenship.

Taitz leave the stand to make her closing arguments.
Taitz states that Obama should be found, because of the evidence presented, ineligible to serve as President.

And with that, the judge closes the hearing.

The "occupy" movement took its campaign against corporate domination to the federal judiciary on Friday, storming the U.S. Supreme Court building and demonstrating at other federal courthouses nationwide to protest the high court’s 2010 "Citizens United" decision.

Brian Kemp to Barack Obama’s attorney: Skip ballot hearing ‘at your own peril’

Below is the full text of the letter from President Barack Obama’s attorney, Michael Jablonski of Atlanta, declaring that he will no longer participate in administrative court hearings on a challenge to Obama’s spot on Georgia’s presidential primary ballot.

In essence, Jablonski is putting the onus on Secretary of State Brian Kemp, a Republican, to intervene and bring a halt to the circus. Jablonski includes a copy of Obama’s live birth certificate.

Jerusalem, January 26 - Joseph Zernik, PhD, of Human Rights Alert (NGO), has forwarded to Clerk of the Israeli Supreme Court Sarah Lifschitz [1] and Director of the Courts Administration Judge Moshe Gal [2] requests for comment/corrections on a draft reports, [3,4] which document fraud in the electronic records of the Supreme Court of the State of Israel.

One report focuses on the publication of simulated records and conduct of simulated litigation. [5]

The other report focuses on records that were fraudulently certified around 2002, when the former Clerk of the Court Shmaryahu Cohen died on the job of a sudden heart attack in office, and apparent refusal of the current Clerk of the Supreme Court Sarah Lifschitz to certify any records of the Court since 2003.

The fraud in the electronic record systems of the Israeli Supreme Court is similar to the large-scale fraud that has been previously documented in the electronic records of the US courts (PACER and CM/ECF). [6] Moreover, a report presented in the 16th World Criminology Congress documented the tight linkage between corruption of the US courts and failing banking regulation under the current financial crisis. [7]

However, according to Dr Zernik, a critical difference between the situation in the US and Israel is that in Israel, both computing and legal scholars are willing to discuss the matter, and even propose solutions. Legal and computing experts in the United States have consistently refused to opine on the matter. [8-10]

Integrity of the electronic record systems of the courts is critical in the safeguard of Human Rights and Civil Society in the digital era.

(Reuters) - The top United Nations human rights official criticized Iraq on Tuesday for carrying out a large number of executions, including 34 on a single day last week, and voiced concern about due process and the fairness of trials.

"Even if the most scrupulous fair trial standards were observed, this would be a terrifying number of executions to take place in a single day," U.N. High Commissioner for Human Rights Navi Pillay said, in a statement referring to executions carried out on January 19.

"Given the lack of transparency in court proceedings, major concerns about due process and fairness of trials, and the very wide range of offences for which the death penalty can be imposed in Iraq, it is a truly shocking figure," she added.

The authenticity, or lack thereof, of the digital record that was produced by the White House as Obama's long form birth certificate is not likely to be settled by the US courts anytime soon. State and US courts
Prisons
Banks
Mortgage registration
Land ownership registration
Banking and exchange regulating agencies
Voting machines
Supreme Court of the United States.

If the US District Court in Georgia decides that the president is not permitted to admit false and deliberately misleading, digitally-generated records in court, then the People may later demand that the same standard be applied to the banks, or even the courts...

Among the records, which were reviewed (dates are best estimates), under the tenure of Chief Justice Aharon Barak:

The Israeli Courts Administration is asked to produce records pertaining to change in the Clerk’s electronic certification around the untimely death of Clerk of the Supreme Court Shmaryahu Cohen
Today, the Supreme Court of Israel issues all its decisions uncertified, “subject to editing and phrasing changes”. What was the basis for the Supreme Court’s switch into issuing simulated, tentative-basis decisions?

Jerusalem, January 19 previous reports, issued by Human Rights Alert (NGO) regarding the electronic records of the Supreme Court of the State of Israel showed:

Routine issuance of simulated judicial records and conduct of simulated case reviews, [1,2] and
Profound changes in the Clerk’s certification in late 2001-early 2002, around the untimely death of Clerk Shmaryahu Cohen. [3]

Today, a Freedom of Information request was filed with the Courts Administration, [4] for records that would shed light on the changes in the certification procedures.
The previous report [3] tied the death of Shmaryahu Cohen (March 2002) to:

Deletion of the certification statement, “True copy of the original”
Addition of a disclaimer, “Version subject to editing and phrasing changes”
Deletion of the individual Clerk’s name and the authority of the office of the Clerk of the Court.

Additionally, the initial report [1] documented that the Supreme Court today:

Routinely fails to duly serve its decisions;
Refuses to permit the office of the Clerk to certify the Court’s decisions;
Refuses to apostille certify, pursuant to the Hague Convention (1961), key records of the Court.

Such conduct undermines the rule of law, as most clearly documented by the recent conduct of Justice Yoram Danziger and others in the Supreme Court. [5]

In the United States, where similar electronic record systems had been implemented a decade earlier, they opened the door for widespread corruption of the courts, undermining the foundation of Human Rights and Civil Society.[6,7] Moreover, such conduct in the courts also undermines effective banking regulation. [8]
Computing experts, who are readily available in Israel, should assist the appropriate State agencies in review and repair of the electronic record systems of the Israeli courts. [9] Additional proposed corrective measures include reform of the office of the Clerk of the Court in the State of Israel.

Survey of the electronic decision forms of the Supreme Court over the past two decades shows continuous erosion in their validity and integrity. Key events took place under the tenure of former Chief Justice AHARON BARAK (1995-2006). Irregularities are particularly noted around the untimely death (March 2002) of Clerk of the Court SHMARYAHU COHEN from an on-the-job heart attack. Further investigation may establish that in the months prior to his death, the Late Clerk SHMARYAHU COHEN created permanent internal and public records of his protest against the corruption of the electronic record systems of the Supreme Court. Jerusalem, January 17 – in a previous study, Joseph Zernik, PhD, Human Rights Alert (NGO), documented that the issuance of simulated decisions and conduct of simulated case reviews are enabled and practiced through the electronic record systems of the Supreme Court of the State of Israel. [1,2] In a supplemental study, released today, Dr Zernik provides detailed review of the evolution of the electronic decision form of the Supreme Court, and noted material irregularities in this respect around 2001-2002, and beyond. The supplemental study was based on review of Writs, Decisions, and Judgments from the online public access systems of the Supreme Court: Elyon1 (1988-2010), Elyon2 (1999-~January 1, 2002 and ~February 20, 2002-2010), and records found through Google searches (1997-2011)

The results were compiled and posted online, a) Summary Table, b) Survey Notes, and c) Survey Records (Writs, Decisions, Judgments). [3]The survey shows:

Continuous erosion in the validity and integrity of the electronic decision forms, relative to the attestation by the Clerk of the Court, particularly under the tenure of Chief Justice Aharon Barak (1995-2006), and
Inexplicable irregularities in court records in the months surrounding the untimely death of Clerk of the Court Shmaryahu Cohen from an on-the-job heart attack in early March 2002.

Of note:

On November 13, 2001, Sarah Lifschitz attested a judicial record as Clerk of the Court, albeit using a new attestation form that should be considered compromised, and is similar to the one used today. Shmaryahu Cohen continues to sign as Clerk of the Court almost until his last day, in early March 2002.
New Court case files are missing from the index of the contemporary system, Elyon2, corresponding approximately to the Case Filing Dates of January 1, 2002 and February 20, 2002. Some, but not all of the files are found on the legacy system Elyon1.

Further investigations may establish that in the months prior to his death, the Supreme Court Clerk Shmaryahu Cohen created permanent internal and public records of his protest against the corruption of the electronic record systems of the Supreme Court.

The matter should be thoroughly and publicly investigated.

In studies published and presented in international, peer-reviewed computer science and criminology conferences, Dr Zernik showed that similar systems, which had been implemented in the US courts a decade earlier opened the way for widespread corruption of the courts and failing banking regulation. 10 Reasons the U.S. is no Longer the Land of the Free

January 14, 2012 "WP" -- Every year, the State Department issues reports on individual rights in other countries, monitoring the passage of restrictive laws and regulations around the world. Iran, for example, has been criticized for denying fair public trials and limiting privacy, while Russia has been taken to task for undermining due process. Other countries have been condemned for the use of secret evidence and torture.

Even as we pass judgment on countries we consider unfree, Americans remain confident that any definition of a free nation must include their own the land of free. Yet, the laws and practices of the land should shake that confidence. In the decade since Sept. 11, 2001, this country has comprehensively reduced civil liberties in the name of an expanded security state. The most recent example of this was the National Defense Authorization Act, signed Dec. 31, which allows for the indefinite detention of citizens. At what point does the reduction of individual rights in our country change how we define ourselves?

While each new national security power Washington has embraced was controversial when enacted, they are often discussed in isolation. But they don’t operate in isolation. They form a mosaic of powers under which our country could be considered, at least in part, authoritarian. Americans often proclaim our nation as a symbol of freedom to the world while dismissing nations such as Cuba and China as categorically unfree. Yet, objectively, we may be only half right. Those countries do lack basic individual rights such as due process, placing them outside any reasonable definition of “free,” but the United States now has much more in common with such regimes than anyone may like to admit.

These countries also have constitutions that purport to guarantee freedoms and rights. But their governments have broad discretion in denying those rights and few real avenues for challenges by citizens precisely the problem with the new laws in this country.

The list of powers acquired by the U.S. government since 9/11 puts us in rather troubling company.

Sure, they did it before, with Wikileaks... Is it possible that "mainstream" media engage in a blackout? Sure, NYT gave you notice that it was intimidated ... Through oppressive deprivation of First Amendment rights the US federal government is setting the ground for an inglorious civil unrest.

Los Angeles, January 15 - starting about 24 hours ago, a "rumor"/"story" has been circulating on the web, that Paypal blocked funds (>$40.000) in the account of Tea Party activist Sheriff Mack. The money was apparently designated for a conference.

At this time, the same story appears in numerous sites:

The most common is a note starting, "I just spoke to Sheriff Mack and was advised that PayPalhas frozen that portion of the funds donated through PayPal ($40000+) for the ..." [1]
The Youtube video says, "Sheriff Richard Mac on Pastor Butch Paugh's GCN radio show on 01.12.2012, about a $46,000 frozen Paypal Account, warning to others about the problems using paypal on a large scale." [2]

However, Google queries fail to provide any hits from "mainstream" corporate media. [1]

Such a fuzzy situation calls for some educated guesses:

Is it possible that Paypal did such a thing? Sure, they did it before, with Wikileaks...
Is it possible that "mainstream" media engage in a blackout? Sure, the New York Times gave you notice, specifically stating that it was intimidated following the Wikileaks episode, and would not publish information detrimental to the banking industry... [3]

The prevailing conditions, reflected in these speculations, show how low we have gone in deprivation of the freedoms of speech, press, and assembly, which are quintessential for Civil Society.

This treatment was not reserved for the Tea Party, either. Events surrounding Occupy events show:

Denial of the basic freedoms of speech and assembly in numerous locations, often through the application of excessive force.
Initial blackout by mainstream media, and concerted efforts to block on-site streamline broadcasts.
Censorship by Google, at US agencies request, of Occupy videos, posted on Youtube by Russia Today. [4]
Infiltration by undercover police. UC Irvine Prof Erwin Chemerinsky called such surveillance very troubling because it “risks chilling free-speech activity,” while acknowledging that he was not in line with the courts in this matter. [5]

The case of freezing Wikileaks' funds by banking institutions, and even more so the intimidation of the New York Times, also show that all realize that the courts would defer in such matters to banking interests.

Corruption of the state and US courts has been one of the least covered aspect of the current crisis. [6] It has been repeatedly documented that the US courts have adopted a policy, denying the right to file petitions, in cases related to judicial corruption. [7] Access to Federal Grand Jury is denied as well.

Denial of these basic rights makes the current crisis more likely to escalate. Previously, many were calling for a Constitutional Convention, [8] hoping for a "Glorious Revolution", or conflict resolutions as practiced in Quebec. [9] Such peaceful transitions could only take place in societies that are fundamentally committed to some level of civility, including, but not limited to the freedoms of speech, assembly, press, freedom to file petitions, and some integrity in the electoral process.

Now, it appears more practical for the dissenters to study the causes, conduct, and outcomes of the Civil War. [10]

The dissent movements, from Constitutional Convention, through Birthers Tea Party, Occupy and Montana Freemen, have more in common than they realize. LONDON (AP) � Britain's spy agencies will face a criminal investigation into claims that intelligence shared with Moammar Gadhafi's regime led to the torture or rendition of two Libyan men and their families, authorities announced Thursday.

A criminal inquiry was launched in 2008 when a former Guantanamo Bay detainee alleged that intelligence agencies were complicit in his torture. The inquiry later expanded to include claims by two Libyans who accused intelligence agents of sharing sensitive information with Gadhafi's regime.

"We want to get to the bottom of this � not just on grounds of justice or ethical considerations, but because this whole saga has threatened to make Britain less safe," said Conservative lawmaker Andrew Tyrie who chairs a special committee on the practice of extraordinary rendition.

Tripoli's military council commander Abdel-Hakim Belhaj, a former fighter in the Libyan Islamic Fighting Group which had opposed Gadhafi and had asylum in the U.K., claims both British and U.S. intelligence may have played a role in his 2004 detention in Thailand's capital Bangkok and transfer to Tripoli.

Documents uncovered during the fall of Tripoli disclosed the close working ties between Gadhafi's spies and Western intelligence officials. One document allegedly contained a message from an agent from the British foreign spy agency MI6 making reference to the rendition of Belhaj, also known as Abu 'Abd Allah Sadiq.

"I congratulate you on the safe arrival of Abu 'Abd Allah Sadiq," the message said. "This was the least we could do for you and Libya to demonstrate the remarkable relationship we have built over recent years."

Belhaj, who said his pregnant wife was also abused, praised the decision Thursday to open a criminal inquiry.

"I trust the police will get to the bottom of this, and find not just the rank-and-file agents, but those ministers who were truly responsible for her suffering," Belhaj said. "To this day, I cannot understand why my pregnant wife was put on the same plane and abused as well."

Sami al-Saadi, another Libyan who had been opposed to Gadhafi, also claims MI6 played a role in his rendition.

The New York-based Human Rights Watch found a cache of documents in the abandoned office of Gadhafi's former intelligence chief, Moussa Koussa, after the fall of the regime. Among them was a fax the CIA sent to Koussa in March 2004, which purportedly showed that the agency would support MI6 and Gadhafi in seeking Saadi's rendition.

Two days after the fax, former British Prime Minister Tony Blair flew to Tripoli to meet Gadhafi. The two were photographed embracing and several deals were announced, including a multimillion pound agreement for a gas exploration contract with Shell, the Anglo-Dutch oil giant.

The visit came after Libya bowed to international pressure and agreed in 2003 to abandon weapons of mass destruction.

Still, Saadi, his wife and four children were bundled onto a plane from Hong Kong to Libya where they were then separated. Saadi claims he was tortured.

It's not is not clear whether investigators could call on Blair for questioning. Former Foreign Secretary, Jack Straw, said he did not know about the rendition.

MI6 chief John Sawers said Thursday it was in the agency's interest to deal with the new allegations "as swiftly as possible so we can draw a line under them and focus on the crucial work we now face in the future."

While British intelligence agents will face new questions over the Libyans' claims, prosecutors and police said Thursday there was insufficient evidence to prove that agents were complicit in the alleged torture or mistreatment of former Guantanamo detainees.

The case that prompted the initial investigation was that of former Guantanamo detainee Binyam Mohamed.

Mohamed, an Ethiopian who moved to Britain as a teenager and was initially held in Pakistan, says he was sent by the U.S. to Morocco where he was interrogated and brutally tortured. He alleges that he told an MI5 officer of his mistreatment in 2002.

Keir Starmer, Director of Public Prosecutions, said there was evidence that intelligence agents provided information to the US authorities about Mohamed and also supplied questions for them. But, he said, there was "insufficient evidence to prove to the standard required in a criminal court" that any spies provided information when they knew he was being tortured, or suspected he was at risk.

Mohamed said Thursday he hadn't expected British spies to be charged, but that new evidence may eventually emerge that would reopen cases.

"If there is any further and wider criminal investigation ... I believe it would be completely impossible to decide that there has not been a pattern of massive complicity by UK bodies in criminality at the highest levels directed at other Muslim prisoners," Mohamed said. "My experience was not isolated; it was part of a pattern."

Eliza Manningham-Buller, a former head of MI5, has said she believes the U.S. deliberately misled its allies over its handling of detainees during the so-called war on terror.

In a separate allegation of complicity from a former detainee, investigators also say they failed to find sufficient evidence � mostly because they lacked access to witnesses and the detainee who had been held by U.S. authorities at the Bagram Air Base in Afghanistan.

Some 3,000 terror suspects continue to be held at the secretive detention facility where detainees lack access to lawyers. Human rights organizations have repeatedly criticized U.S. authorities for a lack of transparency and legal protection for the detainees.

"One thing you read very clearly in those materials is that it is not that there wasn't torture, it is not that the British weren't involved, it is that there are witnesses who are not available to put their part," said Clive Stafford Smith, a lawyer with the legal charity Reprieve who represents some of the alleged victims of torture and rendition.

Most of the torture allegations came from terror suspects who were either initially held in Pakistan and Afghanistan, or sent to other countries such as Morocco for interrogation.

British agents were accused of passing on information about detainees but not of direct abuse.

Britain has already made payouts to 16 former detainees at Guantanamo. Among those alleged to have been part of the settlements were Mohamed, Bishar Al Rawi, Jamil El Banna, Richard Belmar, Omar Deghayes, Moazzam Begg and Martin Mubanga.

British prosecutors and police said that while there was insufficient evidence to bring criminal charges now, cases could be reopened if new evidence emerges.

A separate government inquiry into Britain's role in the so-called war on terror is expected to begin later this year.
